This was a disaster for the Second Amendment.
A judge took a sledgehammer to the constitutional freedoms of gun owners.
Now millions are going to be affected by this horrendous ruling.
In 2021, Missouri passed the Second Amendment Preservation Act, a law that would have prevented local law enforcement from cooperating with gun grabs by the Feds.
This was a model piece of legislation for states that were looking to fight back against an increasingly anti-gun federal government and their various gun control schemes.
Naturally, the gun control lobby challenged it in court, looking for a friendly judge to come in and save them.
It appears that they found such a panel of judges, as the Eighth Circuit Court of Appeals blocked the law and returned gun control to the state of Missouri.
This is going to affect millions of people, as Missouri is a large state that has a huge number of gun owners who are now going to have to deal with additional restrictions.
And it’s all thanks to activist judges who refuse to follow their oath and protect the Second Amendment.
According to the Missouri Independent, “A Missouri law declaring some federal gun regulations ‘invalid’ is unconstitutional because it violates the U.S. Constitution’s supremacy clause, a federal appeals court in St. Louis unanimously ruled on Monday.
“A three-judge panel of the Eighth Circuit Court of Appeals agreed with a district court ruling from last year that blocked Missouri from enforcing the Second Amendment Preservation Act, a law passed in 2021 that penalizes police for enforcing certain federal gun laws.”
Unfortunately, judges have become so ideological that getting a certain ruling is simply a matter of shopping around for a judge who has certain political views.
If someone manages to find a friendly enough judge they can get practically any ruling they want on a hot-button issue.
The article continues, “Some of the gun regulations deemed invalid by the law include imposing certain taxes on firearms, requiring gun owners to register their weapons and laws prohibiting ‘law-abiding’ residents from possessing or transferring their guns.”
“The U.S. Department of Justice filed the lawsuit challenging the law arguing it has undermined federal drug and weapons investigations. Late last year, the U.S. Supreme Court denied a request by Attorney General Andrew Bailey to allow Missouri to enforce the Second Amendment Preservation Act while its appeal is ongoing.”
Garland and his DOJ have been as hostile to gun freedoms as any federal agency in the country in recent memory.
They have consistently done the bidding of the most extreme gun control lobbying organizations in the country, which naturally have in turn supported Joe Biden and Kamala Harris politically.
Now they have managed to get a state law protecting gun owners struck down in court by a panel of judges who are apparently hostile to the Second Amendment.
The damage being done to the Second Amendment by anti-gun judges and the Biden-Harris administration has unfortunately continued with a very questionable ruling in Missouri.
